The Department of Finance, Service & Innovation, NSW Fair Trading operates the NSW Swimming Pool Register website (the Register). This privacy statement explains how your privacy is protected when:
NSW Fair Trading and all authorised users of the Register must comply with the Privacy and Personal Information Protection Act 1998. You can obtain further information about this legislation from the NSW Privacy Commissioner.
The Register is an online facility for swimming pool and spa owners, NSW councils and authorised private certifiers.
Swimming pool and spa owners can use the Register to enter details about swimming pools and spas, perform a self-assessment of swimming pools and spas and obtain a Registration Certificate for swimming pools and spas they have registered.
Authorised users in NSW councils may access registration information for swimming pools and spas in their local government areas. They may register swimming pools and spas on behalf of owners and update information when necessary, record information about inspections and issue certificates of registration and compliance.
Private certifiers, being accredited by the NSW Building Professionals Board may access information about swimming pools and spas on properties where the property owner has engaged the private certifier to conduct an inspection to determine swimming pool barrier compliance.
When you browse the Register, NSW Fair Trading logs the following information for statistical purposes – your server address, top level domain name (e.g. .com, .gov, .au, .uk etc), the date and time of your visit, the pages accessed, documents downloaded, the previous site visited and the type of browser used.
NSW Fair Trading will not try to identify users or their browsing activities, except in the event of a lawful investigation by a law enforcement agency.
When you register a swimming pool or spa the Register records information about your property and the swimming pools and spas you register. The details you enter are displayed on screen. Other information relating to your property is obtained from NSW Land Registry Services (NSW LRS). This information includes your property’s unique identifier, location coordinates, local government area and Australia Post Delivery Point Identifier. This information is used by your local council for compliance purposes only.
All the information you enter and information obtained from LRS during registration is made available to authorised officers of your local council. The information is not available to authorised council officers from other local councils or unathorised third parties. Private certifiers, who are authorised users, may access registration information for the purposes of pool inspection and certification only.
Private certifiers may only access information for individual properties – they cannot access consolidated information for multiple properties.
NSW Fair Trading reserves the right to make disclosures to relevant NSW local councils and law enforcement agencies where this is required by law or is otherwise part of a lawful investigation.
